Ok, i couldn't let this amaizing stupidy go with out a rant.

Metallics's suit agains Napster is unecessary and dow right hipocritical. Matellica is being lead around by a money craving lawyer who is suing them jsut to jump on the band waggon (no pun intended). The fact that Napster is already being sud by the MPAA whic represents Metallica shows that there i no need for indiovidual band to sue Napster. So, hwi is Metallics suing Npater.... Money. If the RIAA wins the lawsuit the band that they represent won't see a single penny and Metallia doesn't want to be left out.

The fact is that Metallica probaly has not lot a single dollar to MP3's and Napster. The good majoruity of mucis pirates would never buy the CD that they are doenloading in the first place. For others being able to listen to an eniter album before thay buy can stimulate CD sales. Lets be honest, portiable MP3 players aren't cheep or have high storage capacity, and MP3 its self don't sound all that great on High end systems. But metallica insists on Sueing Napster. And stoping Napster won't stop Mp3's, there will always be FTP, and other programs like Gbnutella, iMesh, Scour, CuteMX. Stoping Napster won't stop MP3. And thoes 300000 users banned for Napster? it takes un der five minuets to create a new account. So, it has to be blatently obvious to napster and their mp3 chasing lawyer that tehy are not gonna stop Mp3s

And a third thing, the hipopracy. There was a tile that Metallica and other HArd Rock bands would encourage bootelgging to get their name out there and to get known. Then they sell out. Then for a band to go out and annilaite 300000+ of its fans is just stupid. Any band should know haveing more fans is a good thing. There has been a hughe back lash a agins metallica now, and it might cause their CD sals to slump further. In my oppinion Metallica is just a whashed up rock band looking for their next source of income, and itr hapens to be through lawsuits.

Of course, (in the words of Dennis Miller) thats my opinion, I could be wrong.

That's the fallacy that seems to make it ok. "These guys are rock stars. They're probably billionaires. They're not going to miss my couple of dollars." This is wrong. People are not necessarily wealthy just because they are celebrities, and while you may not consider your few dollars to mean much, 300,000 peoples' few dollars do.

What they're trying to avoid is the call from the record company saying since their sales are down, they're being dropped from the label. Now, if sales are down because the band loses popularity, then so be it. That's the way things go when you're in the music business. But if sales are down because people are downloading the free music that they would have purchased otherwise, then this is simply not right.

Me, I wonder if the folks in here defending Napster and the right to download free music are the same people who railed against those buying and selling bootleg copies of the South Park movie because it was taking money out of Parker and Stone's pockets.

I find it totally pathetic...I'm sorry, but it is! Think about it, they've been around how long? Sold (out) how many albums? Done how many tours? Have how many fans? And now basically they are suing their fans...I mean if someone didn't like Metallica, why download the song?

That's an opinion. Me, I never cared for heavy metal regardless of which band played it, but I can still see that if what Napter's doing to the music industry happened to other segments of the population, the fallout would be tremendous.

But, in this case, they do. Metallica is rich. If any particular members are not, they squandered it.

Not trying to justify piracy, but they *are* rich by just about anyone's standards. Maybe not Bill Gates's standards, but hey...

The fact does remain that no one can prove much loss of money by piracy, for you can't prove that someone would have bought the original product if the pirate version wasn't available. Let's say that Napster gets the boot -- those "pirates" would still dub a CD onto a cassette or rip a CD (also probably copied in a burner) into an MP3 before buying the original.

If anything, I believe that such exchanging actually increases sales. Radio play -- anyone can copy songs from the radio, but no one denies that radio play increases sales. If I get my paws on some pirate music, be it tape or whatever -- *and I like it* -- I will buy the original, simply because I want the original, not because I want to help the artist, etc. I like having the original booklet, not a photocopy or scan, or none at all. And if I hadn't heard the the music via the pirate copy, I would probably never have bought the original seeing as how radio is unbearable and MTV is unwatchable -- not to mention homogenized and lacking most of the artists I want to hear or see.

We have gone through this before. Radio was going to kill sales...VCRs were going to kill the theater market. In turns out that they stimulated the market. What the record companies (and Metallica) should do is embrace new technology, lower prices, reach more people, and ultimately make more money for themselves.

If they were put up to this by their record company, they're spineless shitbrained puppets. If they did it on their own, they're greedy opportunists, prosecuting because they *can*[1]. [1] I'd like to see them sue the kid who copies one of their albums in his bedroom to give to a friend, and doesn't even have a computer.

Actually, I'd like to see them go after fans who filmed their early concerts. Metallica used to urge their fans to bring in their video cameras and go ahead and film their concerts. With that kind of past, it's no wonder some of their fans now think they've sold out, become The Establishment.

Yup. And if their fans are TRUE, they will BUY the music that adds up to SALES. And isn't that what COUNTS? As for the rest of us, we might like a song or two from an album, and those are the ones we will download. We could just as easily borrow a CD from a fan, or even a tape, or turn on the radio, and copy the song that way and turn those into MP3s. They don't lose money in any of these ways, and they don't lose any money from anyone who downloads a song or two.

If I had half a thimbleful of talent and/or intelligence, I'd WANT my music to get exposed via MP3.com or Napster. Maybe Metallica isn't as talented as it thinks it is.
