But they won't. Know why? He's not selling the episodes. He's selling a blank CD, and for no extra charge, he's putting the episodes (which can ALL be downloaded for free from the Net anyway) on the CD. There's nothing illegal about that is there? No.

Howabout sports ticket scalpers? Guess what? Scalping tickets for profit is illegal, but selling a program for the game and giving a free ticket to go with it is NOT illegal and it happens every day. In two weeks Super Bowl XXXIII will take place 20 minutes from my house. 3/4ths of the people who go will have paid more than the face value for the ticket. At least half of them will have gotten their tickets through brokers who operate in EXACTLY the same fashion as someone who sells bootleg South Park CDs. How many of them will be arrested? Not one.

Ticket brokers aren't illegal. You're allowed to sell a ticket to any event for any damn price you want AS LONG AS IT'S NOT IN THE CITY LIMITS AND ON THE GIVEN DAY OF THE EVENT. That is the law. That is the same law which makes it illegal to sell copyrighted material. So, nobody gets caught? Only one in a million? Ohhh.... Well, then. I guess it's not REALLY wrong then, is it? My uncle once killed a bus full of nuns, but they never caught him. I know what you're saying, we all don't think he did anything wrong either. Hmm... Dave. This is not a loophole at all. Burning anything onto a CD stops it from being a blank. End of story. It is not 'a blank CD with some free episodes' it is a CD with episodes on it. No loophole. No legal doublespeak will change that fact. ( Yes, I *do* know what I am talking about..)

Dunno about the US, but in the UK that loophole has been plugged. (But very rarely is anything done about it.) Partially because it is difficult to stop, but it does not stop totes from being arrested at certain sports events. (Wimbledon is a prime example)

Usually I would agree. But it is obvious that many people on this NG are fans not only of the show but of it's creators. If someone appears to be 'stealing' from them then they will jump to Matt and Trey's defence.

Dave, this is not a simple issue, there are many grey areas. But websites have (IIRC) been closed down due to having downloads on them. I think I am correct in saying that all the large MAME (Multiple Arcade Machine Emulator.) sites have had to withdraw their Game Roms for the same reason. (One of the best, The Mame Shack is not in existence anymore!)

Alright, I'll concede that point. I don't know much about the law except what I get from a few friends who are attorneys. So basically all I know is how to take long expensive lunches while double and triple billing clients. This wasn't my real argument anyway, I was just trying to find a decent seque into the ticket brokers analogy.

Huge massive point #1. The infinitesimal percentage of perpetrators whare actually vaught and procesuted, if they have no prior record (or are a minor for that matter. Really, a 15 year old can set up a CD copying operation without any trouble at all.) they will not receive the stiff penalties described elsewhere in this thread. Probation. "You be good and don't do this no more. Capiche?"

It's the same in the US. There's gonna be a big crackdown on on-site ticket scalpers next week before the Super Bowl, and they'll show them being hauled off in police vans but the rest of the year the cops look the other way. It's amazing. On any given game day, you drive up the street to the stadium, there's one guy with a sigh that says "Need tickets." 150 yards later there's a guy with a sign saying "Got tickets." and the cops just look the other way.

Mentioning the technical term *might* be considered pedantic, but that's not my real argument either. But I'll lighten my stance and say I can understand why someone would hold that position in light of what you said about the show's creators a few paragraphs down. As for non-issue, I meant it didn't have to BE an issue unless the responses started flowing in. Now, for better or worse, it's an issue.

Hmm. That's a word game. "no-one" and "one in a billion" can be taken to mean the same thing. If you disagree on this point, then chalk it up to the subtle (and sometimes not so subtle) differences between British english and American english.

This is the point I mented above. While I watch and enjoy the show, I have no particular affinity for its creators. I've seen interviews with them, and was not impressed. If I knew them personally, I doubt I would spend time with them. So I have a different perspective that the folks you've mentioned.

The rest of my perspective comes from the fact that I am a potential participant in this illegal act because I would really like a CD with all the episodes on it. I downloaded the underpants gnomes episode the other night and it took over an hour and a half. As someone who is pleased to see this CD offered, i can come up with hundreds of reasons why its not such a bad thing.

Interestingly enough, several of this newsgroups regular posters have such "illegal" content on their own Web sites, but the other regulars embrace them instead of castigating them like they do the unfamiliar person who just shows up to post a decidedly on-topic bit of information. Admit that this is a double standard, and this whole portion of the disagreement can die peacefully in its sleep.

I'm not familiar with these sites. What was it about them that got them shut down whuile so many other sites remain active? Anybody?

The point *I* was making Dave, is that in recent years in the UK there has been a HUGE crackdown on this kind of activity. One of the largest 'pirate' markets in Scotland (In the Barrowlands Market in Glasgow), was raided recently , after a similar one last year, and an estimated million odds pounds worth of stuff taken and many people prosecuted.. The game roms (Some of them as old as early 70's ) are obv. copyright. And I can only assume that there was a purge by some of the copyright holders. (Sega etc). Now the only place roms can be found are on easily entered Warez sites etc...

Now.. here is MY dilemma. *I* DO download and use these game roms. Why? Because the games themselves are no longer in production. (When was the last time you saw an original BERZERK cabinet?) (Have you EVER seen one?) And therefore *I* feel that I am stealing from no-one downloading a game that is no longer making anyone any money at all. Not even the website owners. However. I do NOT log onto warez sites and download Photoshop 5 or Windows 98 or similar. WHY? Cos it IS stealing. (You can see my point about grey areas here huh!!?)

Probably not. Interestingly enough, the original eBay auction that prompted this whole discussion was ended prematurely. I got a note from eBay saying they were "out of the loop" and I can now "deal with the seller at my own discretion". ??? Busted? Scared? The more I think about it, the less inclined I am to follow through.

I have about 15 eps on video, but everything on a single CD is so, um, compact. Besies, I spend so much time in front of the PC anyway. ;)

So, seriously, how did you feel when you were dealing with illegally pirated videos? Did you give any thought at all to the issues that have been raised in this thread? Did the thoughts cross your mind? If so, how did you reconcile them, and what changed your mind and brought you to take the opposite position? (Note: "I was young and stupid" would actually be a valid response here.)

True enough, but I'm interested in content, not quality. The ep I downloaded (gnomes) was not the highest quality video, but certainly good enough to catch every detail.

Sure, the money makes a difference. But to me, $10 is really nothing. It's a meal. It's a half a tank of gas. It's a half hour at work. It's almost like a charitable contribution to someone who's doing something that benefits you. I don't see the money as an issue, but for someone who considers it an issue, then it doesn't matter if it's $10 or $1 million, or $1. It's the principle.

Actually, tech support doesn't require a degree or anything, but it'd sure look good on a resume. All you REALLY need is a decent understanding of the products your supporting, and an equally decent understanding of 'customer service' and the job is as good as yours. Besides, the best perk is all the horror stories you get to tell about idiots who call you for help.

A friend of mine who works at a software company in VA sent me a supposedly real one recently about a tech support worker who got fired (but filed a lawsuit claiming unjust termination ... and won!) for dealing with a customer with a new computer calling with "serious" computer probs. Seems their comp wasn't doing ANYTHING. So the tech support guy had them check the connections/cables/power source and comes to find out, about 20 minutes later, the caller was in an building suffering from a total electrical outage (the caller was having trouble seeing as the the only light was coming in through the windows from the outside lights of the building across the street)! The TS Rep told the caller it was indeed a serious prob and to get the boxes which came with the system, pack up the system and take it back to the store where they purchased it. That one's all over the Internet. I'm not sure if that really happened or if it's just an urban legend, but...

I did hear about this case with the lawsuit. Just some idiot with no concept of consequence. I *think* stuff like that all the time, that's what the MUTE button on the phone is for.

All I can vouch for are things that have actually happened to me. I remember back at IBM, a couple of us played a joke on a new hire. He was always asking us stupid questions (because he didn't know jack about PCs and didn't really belong there) so one day, he gets a call, customer has a trap0002. (If you're not familiar with OS/2, a trap is a non-maskable interrupt. It's like a GPF with lots of hex registers and memory locations that fill up the screen, quite impressively I might add). Anyway, he puts the guy on hold and immediately comes over to ask what he should do. A trap0002 is usually caused by mismatched memory chips, but we told him it was a power spike, they're usually caused by squirrels and chipmunks and lizards; anything that touches the "line" outside could fry themselves good AND cause this error. We kept a straight face while he went back and proceeded to spend 5 minutes explaining how squirrels caused his error.

He was fired a few days later.

No, not because of what we did, he was just incompetent.

There was another time I got a call from an OS/2 user in Fairbanks, Alaska. I decided to have a little fun with him, so I asked, "How cold is it up there?" He said, "Right now, it's 14 degrees." I said, "I'm sorry sir, but OS/2 is only supported at temperatures above 32 degrees Fahrenheit." I was waiting for the laugh, and instead he hung up the phone before I could explain it was a joke.

Funny you should mention it. My BS is in Clinical Psychology, but they never told me all it qualified me for was a $10 an hour job doing entrance interviews. Two years of Masters classes later the money ran out. The wanted me to work 30 hours a week for free at a clinic and then write a 40 page "experiential paper" on it. Who am I, Bill freakin' Gates?

Anyway, about this time, a friend who majored in Computer Science had been working at IBM for two years and he said all I needed was a little common sense, the ability to search a database and the knowledge of how to use a fax machine, and I'm instantly qualified to earn $14 per hour take home.

So I worked at IBM in Boca Raton doing tech support for OS/2 (and later, Warp) for two years. If I may make a comparison... I also am a reg on Alt.music.Genesis. There are a whole group of (us) who pass on boots of live recordings. (Yes it is illegal! But ONE difference is that Genesis members themselves have advocated that these bootlegs in NO WAY harm their sales...) AND the members of the NG send these tapes to one another totally free! No payment for post, no tape money, nothing. Simply folk trusting other folk. A difficult thing at best on the net. wouldn't you agree?

That said, there are a few people on THIS NG that, if you hang around for long enough, you will find are actually worth getting to know....More on that later...

Dave, if you need to rationalize your actions by claiming that "people do it all the time" and "it's just taking money from a faceless corporation", then go right ahead. But you're just deluding yourself. It's illegal to sell copyrighted material. It's illegal to BUY copyrighted material. Matt and Trey created, wrote, produced, etc.. Southpark. They own it and the rights to it. It was THEIR creativity and hard work that made the show what it is. The guy selling the CD had nothing to do with it but, in typical me, me, me, fashion, he's got to find his way to make a quick buck for doing absolutely nothing. Tell me ONE thing this idiot has done to deserve to make money off this show. Has he contributed anything to it? No. Their is a reason that we have laws to protect against this kind of thing. And, the distribution of these episodes on the Internet is also illegal, but is FAR less wrong than what this guy is doing. The people on the Internet are just trying to make the episodes more available to people (especially those who don't have Comedy central). CC did, by the way, make an attempt to shut down the major web sites who WERE trying to make money off the show through banners on their pages and such. So, you go ahead and buy you're CD. Save yourself a buck. hell, you can even convince yourself that what you're doing isn't wrong. But the bottom line is that Matt and Trey own the show and can sell it at WHATEVER damn price they feel like. If you don't like that, don't buy it. End of story. But buying this guys CD is absolutely no different than if someone stole a loaf of bread from a supermarket and you bought it off of him for a quarter because you didn't feel like paying the dollar the store was charging. It's not his bread, it's not this guys show to sell and if you decide that you're too damn cheap to buy the episodes yourself, then you are knowingly committing a felony, receiving stolen property and, more than that, you are just plain in the wrong. Think about it. Why are any of us here? Do you watch South Park? I'll bet you do. And I do to. This newsgroup is about the TV show and ANY issues that arise from it. This thread began with a spam post, but it WAS an on-topic spam post. He was offering a South Park CD to members of a South Park newsgroup.

My initial response was that I liked the idea, and I received some contrary responses from that. Granted, two days later the general subject of the thread had changed, but this is what's known as "thread drift" and it happens in every newsgroup on Usenet. People naturally gravitate towards other subjects and move in different directions as the topic in the thread dictates. At one point, someone mentioned the legal and moral implications of selling or buying the CD. This thread would not end abruptly, as several people had valid points that they wanted understood by the others involved in the same discussion.

Your apology is appreciated, but not necessary. I think it's possible that if you HAD been following the thread from the beginning, you would have seen how we all got from point A to point B, and the post you happened to read would have been better understood in proper context. Given the point at which you picked it up, it's understandable that you considered it off-topic and inappropriate.

Okay man, if you really want this to turn into a debate, I can hang with the best of them. Let me just start off by saying that I have downloaded every single episode off the internet, and I have no guilt about that. It was the only way i could see them because I don't get commedy central. I've also downloaded MORE than my fair share of Warez (I'm assuming you know this term :) ). But, at no point have I tried to convince myself that there was nothing wrong with what I was doing. And, I DO have a problem with the guy selling the CD (and have reported him to ebay). He has no right to make a profit off the show. Maybe if he'd spend less time trying to rip off Matt and Trey, he'd be able to come up with some ideas of his own to make money. That's the problem with society today, everyone's after the quick buck. Nobody has a work ethic anymore. As an example, I've recently sold the rights to a game I programmed to a small computer software company. If I found out that someone had taken MY program and was selling it at half the cost, then I would be angry. If you've ever put any time into something and had someone else try to gravy-train off of it, then you'll know what I'm talking about. Now, I'll comment on specific parts of your reply...

What picture would that be? The one this guy's hiding behind? This isn't a question of philosophical or religious differences, it's about the law and what those laws are in place to protect. Actually, it was Commedy Central that made the judgment call. If someone was trying to make a quick easy buck off their product, they shut them down. But, people just doing it to help people (i.e those who had nothing to gain) were left alone.

Thanks for the response. More specifically, thanks for not insulting me for posting my opinion. I suppose I come from the "Live and let live" school of thought. Someone selling bootleg CDs to someone else shouldn't bother you unless it's taking money out of your own pocket. This is a victimless crime.

Either way, it's not like any of this will change anyone's mind.
