"Trick-Or-treater sues neighbours after being injured in fall" - By Laura Grindlay
Vancouver -The family of a girl who fell and broke her arm while
trick-or-treating is suing the neighbour on whose property she fell.
In a writ filed in B.C. Supreme Court last month, Kailey Dawn Hayes, the
infant plaintiff is suing Mansur Azar and Farideh Golzar Azari for general
and special damages for the injuries sustained after falling eight feet from
a walkway on to the driveway of the Azar and Azari home at [Adress
removed],in North Vancouver
The girl, who lives at [Adress removed], with her guardian and step
brother Darren Hayes was trick or treating with him when they walked to the
front door of the defendants house.
The suit was filed by Mr. Hayes on behalf of the six year old.
"An occupied of the premises answered the door and turned on the porch
light, advising they were not receiving trick=or-treaters" the writ states.
"The occupier then turned off the porch light, leaving the walkway in
darkness. As the infant plaintiff walked back towards the street level, she
fell of the walkway on to the driveway and sustained personal injuries,
damages and losses."
The accident was caused solely by the negligence of the defendants, the
writ says, by failing to provide adequate lighting and an adequate handrail,
failing to indicate the drop-off and failing to take reasonable care to
ensure the infant plaintiff would be reasonably safe exiting the premises.
The girl suffered a broken arm, an injured hip, headaches, multiple
abrasions, shock and anxiety.
The writ says the injuries, loss and damage have caused the girl pain,
suffering, loss of enjoyment of life, physical disability and loss of
capacity to earn income in the future.
Miss. Hayes lawyer, Clive Boulton, said the writ has yet to be served on
the defendants, who are out of town.
"I guess every kid is hopeful there will be candy at every house, but
there were no lights on. The argument here is there is no railing along the
edge between the front yard level and the driveway level" he said "She
basically just walked off the edge. She thought she was walking straight
out.
Mr. Boulton said the girl had only been trick-or-treating at a few
houses when she fell.
She'd been trying on her Halloween costume for days and days before the
event and it cut her Halloween short" she said.
