If you really want to avoid legal troubles for as long as possible, I'd recommend removing Season 1 & 2 stuff ... as long as only episodes that aren't commercially available are being shared, you'll be less likely to anger Fox. And, of course, remove episodes as future DVDs are released (assuming your server is still up at that time).
