How can Brazil sue Fox who is in the U.S.? Unless fox goes to court, even if they loose, What can Brazil do? Probably not much. They can't force them to pay.

Someone else addressed this issue either in this thread or in another thread on the same topic. FOX did not sue the Duff Brewery, they politely asked them to change their name, since FOX did, afterall, own the copyright to the name "Duff Brewery".

FOX then provided the brewery with the money they needed to make that change.

Hardly the same thing.

Indeed. And if that brewery had actually been in business using that name for over 100 years then they should have made sure it was protected. It doesn't matter if it's their family name or not. Fox owns the rights. I couldn't all of a sudden decide that I wanted to go into the video football game business and use my last name in the titles just because it's my name. Someone else already owns the rights to market such things with that name.

They changed their name to McDuffs and fox helped them pay for the expenses in getting the name changed, changing the logos etc.

Technically, it is Brazil's Department of Tourism that is suing Fox for undoing all the work they have done in creating a positive image of Brazil in the eyes of the American public. I totally agree that the suit is dumb, but is it any more dumb than Fox shutting down the Australian Duff Brewery? Methinks Fox's overzealous legal department is getting a taste of its own medicine.

First of all they didn't shut down that brewery. They politely informed them that they should change the name and were very helpful in helping them get it done. And yes there is a big difference in legally enforcing your legally enforceable copyright and having no understanding of satire and thinking that people will take the simpsons portrayal of Brazil seriously.

This is very true. I just read a very long, probably too long, article about Intel asking some tiny organization that was using the phrase "Yoga Inside" to please change their phrase to something less like "Intel Inside". I thought that Intel was a big bad wolf at first, but in fact after reading the article I almost liked Intel for a minute (but not Microsoft. I still hate them. But I buy everything they tell me to). They are almost obligated by law to stop copyright infringement, and they are given a large leeway in which to do it. Identity Dilution is what it's called.

But Brazil just can't take a joke. Get a sense of humor, you Portuguese-speaking-wild-monkey-coddling-rainforest-burning-Pele-idolizing-a fter-all-these-years-narrow gauge-railroad-loving-capital-with-the-lamest-name (Brasilia)-just-got-a-constitution-in-1988-(CIA world factbook) you-big-losers-you!!

everyone has heard the latest. They are backing away from that. They haven't even seen the episode yet. Npr reports they are mostly mad that it wasn't accurate. The way people think Puerto Ricans are Mexicans and such. Also they reported the staff at the simpsons reply was that they wouldn't address it and withhold comment until the State Department made some formal declaration or something like that. I think that's funny.
