Fox has taken out the Duff Brewery in New Zealand. http://www.stuff.co.nz/inl/index/0,1008,1030625a11,FF.html . Gavin and Bev Duff started their brewery in 1991, but as their names suggest, weren't inspired by the TV show.
"I've only watched it once. My daughter rang me up and said you'd better turn on the TV they're having a tour through the Duff brewery in the Simpsons," Mr Duff said.
What did he think of the show?
"It's rubbish," he said.
As much is it might suck for that family...whoever gets the copyright or trademark first is the owner. Of course that's US law, they may have some recourse in New Zealand.

Well no they don't have a trademark on Duff Beer but the name is probably copyrighted as part of The Simpsons and just the same you can't produce a product and use a copyrighted name for that product. Fox being the owner of the copyright has the right to make these people stop whether the infringement was intentional or not. I think they are being very nice though...probably because they know it was unintentional.
The article I read about that said that Fox was helping them redo their labels and such; it sounded much more courteous than other trademark battles I've seen.
