Doesn't he jump out his window in an early episode (possibly his first appearance) and it turns out it was only on the second floor?

Exactly my thought, however, in the FLEAS episode, just shown, Newman's apartment was clearly 5F - so now we have a double inconsistency, mere coincidence ???? or deliberate ?????
