I live in Ohio, and when I visited a friend in Michigan, I was surprised at how much a 12-pack of pop costs because of the tax that is added. This is the tax that you get back when you then cash in the cans at your local recycling center. So I would assume that at least technically, it would be illegal to cash a can in for that "extra" money that you didn't have to pay as a tax in the first place. How this could ever be actually enforced, however...

   Whether or not you PAY the deposit is immaterial.  The whole idea is to
    get the bottles and cans recycled. Anyone can return them.
