I don't think Ross was legally married to Emily. Emily was mad at Ross after he mentions Rachel's name in the wedding vows, instead of Emily's.

I don't think sex has anything to do with the legalities of marriage. I think Rachel was just trying to point out how dysfunctional their marriage was in that short time. If you remember, the judge didn't grant the annulment.
