Baby Custody -- Stirring The Pot (Spoiler through 813)

It occurs to me that every discussion I've read here about Rachel and Ross versus Rachel and Joey have assumed that if Ross and Rachel do not get together that Rachel will have custody of Baby Girl Green/Gellar, and the baby will live with her, presumably along with Joey. Why is that? Ross certainly has more experience being a parent than Rachel. Ross certainly has proven himself more capable of a child care giver than Rachel. I agree a baby needs her mommy, but a baby equally needs her daddy. There has been much discussion on this site that Ross and Mona would make a great long-term couple. Why not hope for them to get together and have the baby live with them? Scott

ShellScott Letteney

Hmmm, not exactly sure I like that plan. Mostly because of the fact that it was pretty much Rachel's decision to have the baby even before she planned to tell Ross about it. Although Ross and Mona might turn out to be a long term couple, it might also freak Mona out to be given such a responsibility so soon.

Amy and DaveShell

By her reaction when she found out she was definately preg., I know she would not give up this baby without a huge fight. She really wants this baby and is so excited about it. I think that ross seems like the better parent at this point because he has more experience, but wait til those maternal instincts kick in.

Frankly, I can't disagree with either of you. The point is that the paternal instinct is as strong as the maternal. To discount that because Rachel and Joey might make a "cute couple" is wrong, and generally sexist. Forget Mona, let Ross be a single father. Better yet, for the sake of the baby, hope for Rachel and Ross to rekindle their love and have a good and happy marriage. Scott

Marriage should be about love, nothing else. No love = divorce. Thats how it was with my parents, my dad loved my mom from the beginning but my mom never loved my dad and that has ruined their marriage.

Rachel and Ross should get a 2 bedroom apartament...they dont' have to get married. They can be roommates( hey it can work!). The baby can sleep in Rachel's room and that way Rachel and Ross have equal access to their child. A baby needs both parents. Ross is a good parent and i'm sure with some help from Monica(lol), Rachel can also learn how to be a good mommy; plus the whole maternal instincts kicking in.

I agree this is the ideal. Ask anyone who has a happy long term marriage, and they will tell you that love is only a part, and perhaps not the most important part. The most important part is the commitment. Love wanes and grows. There many days when the only thing that keeps one or both of the couple from running out of the house is the promise they made all those years ago to stay together.

I actually likethis plan. Your statement that "a baby needs both parents" is one of the most cogent things anyone has said on this subject. Your plan, which I suspect we will soon find is in the works, is far better than any plan but having Rachel and Ross fall back in love and get married.

Love is a big part of marriage but it's not the whole ball game. As a "older" person who has been married 25+ years, I believe marriage is about a whole more things than just love. There's also compatibility, selflessness, respect, sharing common goals, etc. There has to be maturity and a willingness to give and take. When babies come into the picture, the stakes are raised and it's very important to make sure your children are given a solid base. There's a lot of uncertainty in the world and children need to know that they can count on their home being the one place they can go for comfort, stability and love. The ideal, of course, is an intact home with 2 parents.

Many people who "love" each other don't get along and would make terrible marriage partners and/or parents. Liking your spouse is just as important as love.

I might add that in long-term relationships love (eros) ebbs and flows repeatedly over time. It's the depth of the basics that sustain the relationship through the years.

Because bar proven drug addiction, prostitution or anything else of that canon, the parental right automatically goes to the mother. It doesn't matter who might be the "better parent", the mother gets first say about what happens. Always. And technically, because they're not married, I doubt Ross has many rights at all anyway, so he couldn't just decide to take full custody without going through the courts and get away with it. Bottom line: Rachel's the one carrying and giving birth to the child, she's the one with the rights. Ross has very little say in the matter, unfortunately.

Banglebabe30Tina

Has anyone even thought of SHARING custody? They both would make great parents, I think.

As far a full custody went. I can't really see Ross even trying to get it. He was so mad when she got pregnant, that he called condom company for crying out loud. :) Plus, if he wanted to be a full-time dad, he would've tried to get Ben.

He never tried to get his first son, who incidently is living with a woman who's not his favorite person (Susan), and so why would he try to get this new baby who would be living with Rachael, someone he considers a good friend?

TriggerBanglebabe30

I can't even begin to tell all of you how this post has disturbed me! Why shouldn't Rachel have her baby and raise it? She is without a doubt more stable than Ross!! And we all know how much she already loves her baby. She has embraced her pregnancy, while at times Ross finds it a burden. The baby should always stay with the mother unless circumstances render that imposible. And taking Rachel's baby away from her to let Ross raise it would be too cruel for the writers to do in such a popular sitcom. I think that this isn't even an option!

I would agree that Rachel is more stable than Ross. Her character has been allowed to do adult things. She has moved up in her career, step by step. She makes mistakes but seems to learn from them. Ross' character has been written to make stupid mistakes with incredible regularity, which have cost him his job, his relationships, and I must say, his character's support by many viewers. I see his inability to grow emotionally as being the heart of the anti-R&R movement, not exclusively, but prominently. I've mentioned this before in other posts, but I really think Ross needs to get his act together before he can progress to bigger and better things.

As for his interest in the baby: He isn't dating Rachel, and she has expressed an interest in raising the baby alone. Maybe he's trying to give her a little space. He is still going with her to Dr. apointmenvts and they have been discussing baby issues likes names, etc. So, what more can he do to show his interest? And back to our regularly scheduled debate. Honestly? I suspect that baby custody isn't even going to be an issue. They will do as much tag-team parenting from two parallel apartments as an married couple ever did. It won't be an issue.

I never thought that the custody of the baby would be an issue either! I was just saying that Rachel should be a big part of the baby's life (and all mothers, depending on other things). And not that she should be the only person in the baby's life. Ross definately deserves to see his baby, but in my opinion the mother is more important in the raising of a child than the father. This is why women stay home and raise the children (not necissarily all though). But the father is important too!!!

JamesS1889Trigger

In article , "Trigger" writes:

Could it be that the real issue here is over what is technically called "custody"? It sounds to me like you are saying that the baby should live with Rachel and Ross should be able to visit her (perhaps as often as he wants), and anything short of that equates to taking custody away from her?

Banglebabe30 thinks they should share custody (notice how we can't help think of this like it is a divorce, which in a certain sense it in fact *is*?), and you disagree, which is what you meant with your original response? Is that possible? I mean you agree the father is important too, but that doesn't necessarily mean you think he's as important as the mother in this case. --- James Squire - http://members.aol.com/jamess1889

In the states, your statement is absolutely untrue. Granted, I cannot sepak about the laws of every state, but in the great majority of states the presumption in the law that the mother is a better parent no longer exists. There is no presumption that either parent is better. The only quesiton a court asks is "what is in the best interests of the child?" In the absence of a contrary court ruling Ross has completely equal rights regarding the baby under the law, and has a completely equal say. It does not matter if they are married, the father's rights are presumptively equal to the mother's.

I'm not even going to go into the American law system, because the bottom line in this case is that Ross would never take the full custody of the baby when Rachel is his close friend. Why would he do that to her, and most importantly the baby? And what would the consequences be? Now, I know this would create a brilliant opportunity for Ross to marry some woman (e.g. Mona) and move to Scarsdale and take care of his child just like he dreamed of in season 2 (220 TOW Old Yeller Dies), and he would therefore disappear from the show, and there would be no more baby to worry about and create storylines for, but c'mon, do we really believe this will happen? Of course not! Also, it is highly unlikely that Mona will want to take full custody of the kid as well, because as far as we know, she is still Ross's girlfriend and would be a big part of the child's life.

The law and the normal rules in America concerning custody won't be that big of an issue on the show anyway, so my guess is that we won't hear about it at all. In fact, I take it for granted that they'll share custody of the baby. After all, we first found out that Ross and Carol share custody of Ben in 621 TOW Ross Meets Elizabeth's Dad, and as soon as Ross had seen the fetus in 102 TOW The Sonogram At The End, he was as involved as he could be. Why is it going to be so much harder for Rachel and Ross to share custody when Carol and Ross are doing just fine with Ben? Ross and Rachel are friends even though they're not in love anymore, and they live right across the street from each other. Carol and Ross are friends as well, but they don't hang out together every day like Ross and Rachel do. Frankly, I don't see what the big problem is here. Ross has been a great parent to Ben, and he's actually normal and nice when he's together with his son, but I don't think we should write off Rachel as a parent yet. She hasn't even been given the chance to try out her maternal instincts, and I think Ross will be very willing to give her that chance.

So unless David Schwimmer decides to leave the show after this season and the show continues without him, I think it's very likely that Rachel will have that baby living in apartment #19 together with her.

I believe that this season has been about coming up with storylines they know will get a lot of attention in the media and thus huge ratings. They have also managed to come up with good episodes, which is why the show is so popular right now. You're right that they're keeping us in suspense, but I don't necessarily think that a RnR reunion is the only way to go.

Personally, I don't think Ross and Rachel have any romantic feelings for each other right now. That may make me sound like a cynic and not the biggest RnR-fan on the planet, but if we are to look at the recent episodes, the characters have said numerous times that they do not love each other:

Rachel: Yeah, maybe if you're in love. But Ross, we are not in love, are we? - 803 TOW Rachel Tells

Ross: No, it's not what I want either. I mean I-I can't force myself to fall in love with her again now. - 805 TOW Rachel's Date

I choose to believe them when they say they don't love each other anymore. I do realise that their rocky relationship history may make it seem otherwise, but when I look at the season 2+3 episodes nowadays, I cannot recognize the love they had back then in the relationship they have today. They're good friends right now, and they know each other better than they did back then. The wedding in Vegas was the result of the two of them getting hammered (granted, Rachel suggesting a marriage was a bit contrived), and the night where their baby was conceived seemed to me like it was a result of Rachel's idea of a bonus night and too much wine. That's why I think the friendship they have at the moment and the fact that they're having a baby are the two main issues they should focus on. A romantic relationship might end up in a catastrophe, and that's the last thing they need right now. Just my opinion, though. :)

You think Rachel is going to breastfeed?

heeheeheeheeheeheeheeheeheehee yeah, that's a good one. Phoebe would. Monica might. Rachel won't do it for longer than a few weeks. One cracked nipple and she's done.

Yes, exactly. Been there, done that. Two different children. It's rewarding but not easy.

I don't know Claire, I think she might. I never thought I'd be able to do it, but as soon as my son was born, I knew I could never give him anything but the best. It hurt like hell (I know you know) for 6 weeks, but I stuck it out for a year out of love. I think Rachel might be able to do it. At the very least, I think she would breastfeed for the length of her maternity leave. I know from experience that it's really hard to do when you work full-time. Pumping every 2 hours is a major pain in the rear.

Exactly my point! The baby really needs Rachel more (when it is younger).

Because their daughter will/should be living 50% of the time with Ross, Rachel wont be able to breastfeed her or Ross wont be able to give his daughter breastmilk ?

TOW The Breast Milk

Phoebe: Duh, I think I know how to heat breast milk. Ok. (Squirts some on her wrist and tastes it.)

Chandler: What did you just do?

Phoebe: I licked my arm, what?

Ross: It's breast milk.

Phoebe: So?

Rachel: Phoebe, that is juice, squeezed from a person.

Joey: What is the big deal? (Tastes the breast milk.)

Ross had breast milk in a bottle for Ben...

Rachel is not a bitch, and Ross definitely isn't the son of one.

I'd have to go with 75%/25% just because during R&R's relationship trials and tribulations, more or less half the time she was bitchy and their relationship took up around half the time during these 8 seasons so 25% bitchy sounds right, hehe. Wow am I getting picky(sorry abrahammy). :)
