Daria wrote some essay on teena angst and Mr. O'Niell(or whatever his name is) submitted it for her in a Val contest.

The prize was to spend the day with the most self-asorbed poser on the planet. But, since Quinn doesn't know Daria's alive(or tries not to), they'd have the winner meet Val of Val ~Gloria "Eagles may soar but weasals don't get sucked into jet engines."

Um, I was thinking about this while I watched the ep, and couldn't Daria persue legal action against Mr. O'Neill if she really wanted to, for his submission and subsequent exhibition of her work without her consent? Or have I been listening to my lawyer wannabe friend too long?

-Mindy

Mindy said:

Probably. But she wouldn't want to; among other things O'Neill is one of her favorite (or least hated) teachers. It was arrogant of O'Neill to submit her work without her consent, but appropriate behavior for a well-meaning but clueless type such as himself.

Sincerely Yours, Jordan

What makes you think that? I'd think she'd have reason for him to be one of her most hated teachers, even though (or because) she likes the subject.

We see her responding to him more in class than to other teachers. Furthermore, he likes her, and students rarely *hate* teachers who like them. He doesn't completely understand his subject (he misses the hard cynical edge of some literature, blinded as he is by PC), but at least he honestly tries, and that's something Daria would respect. She probably pities him, but I can't see her really hating him, for his conventional-minded weakness and bumbling nature.

The only teacher Daria has whom she might like more would be her art teacher (forget the name at the moment). Though art's really more Jane's special subject.

Not necessarily true. Mr O'Neill's annoyingness, perkiness, and upbeatness are enough to drive her insane, not to mention what he does to a subject she more than likely cares more about than history or science or economics. Besides, I think she's the favorite of most her teachers. Mr DeMartino, even though he yelled "Stop showing off!" in "Esteemsters" looks for her to give a rational answer which is better than Kevin and Brittany's mindless babbling.

You have a point there. His "upbeat" attitude is precisely where he goes wrong in his interpretation of literature too ... much of great literature is about tragic choices.

On the other hand, Daria finds overly cheerful people annoying, she doesn't usually hate them. She doesn't hate Brittany, for example. She reserves hatred for the actively malevolent, not the absurdly misguided.

There's a big difference between being annoyed at someone hugging you, and outright hating them.

Probably. Any good teacher would value a student like Daria.

True. And DeMartino doesn't know her that well in "Esteemsters", that was her first day in class.

So true. Fashion Club, meet Ms. Li, Ms. Li, meet the Fashion Club.

(To me Ms. Li has gone way beyond the point of being "absurdly misguided" in her quest for glory. She's now quite the villainous sort.)

Not to mention any principal worth their salt. I think Daria would find it much easier dealing with an administrator who isn't just out for their own glory, at the expense of the students.

DeMartino rocks. I do like Mr. O'Neill, yes, but there's one thing about him I absolutely can't stand, and that's the way he deals with the Kevins and Brittanys in the class. He asks them things, then tries to rationalize their inability to respond, and then lays the responsibility of explaining what he's asked on Daria. She's probably delighted to get the chance to do what she's good at, but it must feel weird to her knowing that she's only being asked to do this after O'Neill's failed experiments to elicit sensical responses from Kevin and/or Brittany. Don't know, just my opinion....

Whoo-boy! It's clear you haven't read the latest Food&Drug Admin. report on the dangers of eating raw goat. Exerpt follows.

"The consumtion of raw goat should never be attempted. Raw goat is
not only tough and stringy, it provides none of the recommended daily
allowances of any vitamins or minerals and is actually harmful to
most carbon based lifeforms.
Eating raw goat is illegal in most states and the majority of
civilized countries. There is no actual penality for eating raw
goat as what happens to the digestive tract is considered punishment
enough.
Eating raw goat is considered immoral by most right-thinking
people and the majority of religions have banned it's practice.
Eating raw goat causes acne, body odor, dandruff, shortness
of breath, halitosis, and other conditions that will drive away
your friends and family. Raw goat flesh contains parasites and
other chemicals that cause you to act real funny at parties and
not remember what happened the next day.
Eating raw goat will get you talked about.
In closing, eating raw goat is illegal, immoral, addicting,
and fattening and should never be attempted even in months with-
out a 'r' in them."

hope this helps.

Mindy's no idiot (not even by your standards <lol>) and I don't doubt for one minute that she'd think she was going to convince anyone she was "right" just by snipping a (pretty irrelevant, really) little piece of text. Just because you always have to show that you're in the right doesn't give you the right to assume that the same is true of everyone else.

Maybe that's because there is no way to prove that someone intended something when they did something.

I wouldn't say those days are gone. They're just on hold for a while.

Now, I'm not sure what the definition of "psycho" is, but I don't think what I said was particularly psychopathic. I will freely admit to being "unstable" at best, btw. ;) But anyway, you're no good to argue with, you can't hold your end up, you just accuse others of stupidity instead of actually putting forward your "reasoning"....I suspect this may be because your sense of reason is "impaired" to say the least. Feel free to prove me wrong.

[Note the use of the word "prove" in that last sentence.]

I'm probably smarter than you and all. I'm smarter than most, at least. The one thing I'm not insecure about is my intelligence. Unfortunately, intelligence doesn't matter much for anything, being smart by itself won't get you anywhere. :/

Yes, but that's pretty irrelevant. Would you consider calling people stupid to be a good argumentative technique?

hmmm, and I suppose that's why you have the no archive header switched on, so you can't be proved wrong. Kinda makes it a little hard to do research into you doesn't it?

It also makes me wonder what is lurking in your closet. Q's dark little secret, next on sick sad world.

I'd call it natural reaction to get mad at trolls, but you being under the bridge perhaps gives you a different perspective.

Interesting how you and your buddy Tarvok are the only people in the entire group who can see your alledged humour. But of course you are the almighty one, so the fact that the majority think you are not remotely funny doesn't count.

Don't you think you're taking the whole thing a little too seriously? You had an opportunity to show that you weren't some arrogant twat who gets upset whenever anyone says something that could possibly be considered offensive, and you didn't take it. If you hadn't started on about Mindy trolling and had instead posted something funny or something, people might have actually gained some respect for you.

Alli http://voices.vossnet.co.uk/y/yannaco "I fake it so real I am beyond fake..."

There are more than 3 people reading this group, you know.

And why bother always trying prove that you're right and everyone is wrong or lying or stupid, if you aren't bothered about respect? It seems pretty obvious to me that you are desperate for people to respect you, even if you deny it to yourself and everyone else. If you know you're right and you don't care what everyone else thinks, why are you so desperate to prove it to us all? You could let it go, but you don't. You have to show everyone that you are right and whoever you're arguing with is wrong. Maybe you *are* right, but if you know that and you don't need respect from us, why don't you just leave it and let us think you're wrong?

Lying??????
where?

What rubbish.. There is no issue of "fact" here people are simply calling you an idiot...you can`t prove them wrong by doing anything than refraining from idiocy

Q0 wrote in message ...

Wether you are a penguin or not is an issue of fact, not opinion your idiocy, however, is a little more controversial.

You cannot prove you are not an idiot. To claim that you are arguing to "put" people right on this issue is probably either a lie or the bahaviour of an idiot

Nowhere, he can't prove it. I think he's just a bit paranoid LOL. :)

He'll probably claim now that he's not done anything idiotic, that we're the idiots, and that he doesn't have to prove anything because it's so obvious, but we're too idiotic to see it, LOL. :) <awaits bitchy reply from Q-0, which will no doubt appear within the next 10 minutes...> :)

Alli said nothing about herself, here. She made predictions about YOUR position which were correct..(you seem to agree btw) I don`t think congratulations are due fo her predictions, though

Yeah, right. So Mindy's been <gasp!> lying. What're you gonna do, then? Hang her? Beat her with a wet haddock?

Umm..? I said you'd claim that. And you did. I never said you'd be right. You're not, as it happens, although you can claim I'm an idiot 'til you're blue in the face or until I post my mock GCSE results. <g>

Oh, thank you.

Hey, you're right. Maybe you do have something better to do than prat around on usenet.

Please note: I have nothing better to do than prat around on usenet. <g>

Huh? No, you claimed she was lying. That doesn't mean she *was*. I don't think she was, I think either you're a troll, or you're paranoid. <g>

Umm..?

No, because you can't really stop being a penguin, can you? Even if you are an idiot, you refrain from idiocy.

As far as i can make out, she was remarking on being surprised that she was having a pleasant conversation with you..in what way is that provacative? You i take it have never re-evaluated a person on the basis of personal experience. Given the enourmous "meal" you have made of this piddling little issue can you really blame people for being surprised if they manage to communicate?

Pfff... Sometimes I wish DejaNews would post QueroZero's... messages (to be diplomatic). Two reasons, it buggers up the threading for one, and sometimes I like to whack Usenet hornet nests. There's something atavistic and primal about ranting in a flame post...

But mostly, I'm glad DejaNews doesn't.

Sure.

What is your problem with "stupidity" anyway? Is it right to discriminate about people on the basis of their intelligence any more than it is right to discriminate against people on the basis of their appearance or their eye colour or their height or their shoe size? Surely, more relevant is what they do with the intelligence they have.

FWIW, I will admit that I do very little with the intelligence I have. <g>

So you *do* have a sense of humour.... <g>

Huh?

So, you're annoying people.

Why don't you take it to e-mail then, instead of bothering the rest of the group? Or are you trying to humiliate the person you're arguing with?

Why? I never got the impression you were a paricularly caring person. <g> What's it to you anyway? Do you always feel the need to interfere in the lives of people you don't even know? (OK, I'll admit that's more than a little hypocritical... <g>)

Yes, especially if she felt that Daria had been deeply offended.

I think she just said that to make him let go. Daria's uncomfortable with displays of affection.

She's not. She almost likes O'Neill. He's one of her better teachers.

Sincerely Yours, Jordan

I beg to differ. He's everything she hates: he hates anything "downbeat", which Daria sees as necessary in art. He doesn't seem to understand what he teaches, which has a greater effect on Daria, who has a connection (it seems) with literature. He, of all teachers, has complained the most about Daria's "attitude" which seems to be her main problem in school (Helen in her office saying "Tell him I'll talk to Daria about her attitude..." without hearing the call). She obviously wasn't too thrilled with the "writer writing a book about how writers should write books" silly English assignment or many of the others for that matter. She also hates him for his lack of backbone, the fact that he never is able to put up any resistance against Ms. Li (or anyone else for that matter).

Admittedly, the competition is tough, but there's a lot to hate about Mr O'Neill

Your friend may have a future in chasing ambulances. ;-) No serious lawyer who wasn't strapped for cash would ever pursue such a cause of action unless actual damages could be proven-- i.e., if O'Neill submitted the work as his own and profited from it (which he didn't), or he had signed some sort of confidentiality or non-disclosure agreement with Daria (which he didn't), or if there was some sort of statutory provision that forbade teachers from showing the work of their students to others not employed by the school system (which I've never heard of.) Even though Daria did suffer through a day with Whatshername, and even though it probably was some sort of Intentional Infliction of Emotional Distress, O'Neill's not the legal cause of her pain--- Whatshername is, and even then, it's beyond being a stretch to sue someone just for being annoying. Remember, unless there are statutory damages, you've got to prove actual damages.

Granted, it is a violation of trust of a sort on his part, but that ain't enough to beat a Rule 11 Motion for Sanctions, which would almost certainly be brought against any atty bringing such a case. (And which would almost certainly be granted. Ick. Rule 11 is a nasty thing to do to opposing counsel, but if they're yahoos, well, then they deserve it...)

As for Helen's threat of a cause of action against the school in ANC, it was well-grounded in 42 USC s. 1983 (IIRC-- it's been a while since I've done civil rights work... I'm pretty sure that 42 is the right part of the US Code...) --- which is the Federal Civil Rights Statute, and it does provide for damages for those whose civil rights are violated... depending on the state, there may also be a state civil rights statute... Ms Li most definitely violated 1983, and also committed the crime of common law Larceny (tresspassory caption and asportation of the personal property of another with the intent to deprive thereof). <g> She's also vulnerable to a civil suit in state court for Conversion. (Which is lawyer-speak for theft in civil court-- where the victim sues the perp for damages.) For both suits, though, damages still have to be proved IIRC... although for a 1983 suit, I'm not too sure if there's a damages threshhold, or if there's any statutory damages provision... I doubt it... some minimal damages have to be proved, I'd bet...

Considering how Helen had Ms. Li nailed to a wall (considering Ms. Li admitted to everything-- a statement against interest with 3 witnesses would be admissible as evidence in all courts, even though it would be hearsay if entered by getting the testimony of the witnesses), I found it rather amazing that Helen *didn't* sue Ms. Li until she couldn't walk again, pantsuit notwithstanding.

Oh, and BTW, it's a "violation of civil *rights*, not liberties..." (Sorry, but that irritates me... it's the Bill of Rights, not the Bill of Liberties.)

done rambling (for now) ;-) rich.

PS Mindy-- try to dissuade your friend from doing the law thing-- it ain't what you see on TV... it's much nastier at times, and also much more boring, too. :P
